These Terms & Conditions apply to all quotes, orders, artwork, design, printing, finishing, signage, delivery and related services supplied by ABC Printing (“ABC Printing”, “we”, “us”, “our”) to the customer (“customer”, “you”, “your”).
By requesting a quote, approving artwork, paying a deposit, placing an order, or accepting goods or services from ABC Printing, you agree to these Terms & Conditions.
1.1 All quotes are based on the information, specifications, artwork, quantities, materials, turnaround times and delivery requirements provided by the customer at the time of quoting.
1.2 Quotes are valid for 14 days unless otherwise stated in writing. After this period, ABC Printing may revise the quote due to changes in paper, material, labour, freight, supplier, machine, finishing, or other production costs.
1.3 Any change to quantity, size, stock, artwork, finishing, delivery, urgency, or specifications may result in a revised price.
1.4 Unless clearly stated otherwise, prices are quoted in Australian dollars and are exclusive of GST. GST will be added where applicable.
1.5 Verbal estimates are indicative only and are not binding until confirmed in writing by ABC Printing.
2.1 The customer must provide clear, complete and accurate written instructions for each order.
2.2 ABC Printing will produce the order based on the information supplied by the customer. ABC Printing is not responsible for errors, omissions, spelling mistakes, incorrect phone numbers, incorrect addresses, wrong dates, incorrect logos, wrong colours, incorrect sizes, missing bleed, low-resolution artwork, or unclear instructions supplied by the customer.
2.3 If unclear, incomplete, or conflicting instructions cause delays, errors, rework, wastage, or additional production costs, the customer will be responsible for those costs.
3.1 The customer is responsible for supplying artwork in the correct format unless ABC Printing has been engaged to design or prepare the artwork.
3.2 Print-ready files must generally be supplied as high-resolution PDF files with correct size, bleed, crop marks, fonts embedded or outlined, correct colour settings, and images at suitable resolution.
3.3 ABC Printing may check files as a courtesy, but we are not responsible for identifying every possible artwork or content issue.
3.4 If artwork requires correction, resizing, editing, formatting, conversion, recreation, pre-press work, or design support, additional charges may apply.
3.5 ABC Printing is not responsible for print quality issues caused by customer-supplied artwork, including but not limited to low-resolution images, RGB colours, transparency issues, missing fonts, incorrect file size, insufficient bleed, or poor-quality logos.
4.1 Where ABC Printing provides a digital or printed proof, the proof is supplied for customer checking and approval.
4.2 The customer is responsible for checking all details before approval, including spelling, grammar, design, layout, colours, images, logos, dates, quantities, phone numbers, QR codes, barcodes, addresses, finishing, folding, trimming, and all other content.
4.3 Once the customer approves the proof, ABC Printing is authorised to proceed to production.
4.4 After approval, changes may not be possible. If changes are requested after approval, the customer must pay for any additional artwork, production, materials, labour, machine time, wastage, or reprint costs.
4.5 ABC Printing is not responsible for any error that appeared in an approved proof and was not corrected by the customer before production.
4.6 Customer approval may be given by email, text message, WhatsApp, online approval, signature, payment, or any other written confirmation accepted by ABC Printing.
5.1 Printed colours may vary from screen colours, previous print runs, office printer samples, online previews, or customer expectations.
5.2 Colour variation may occur due to paper stock, finish, lamination, coating, machine calibration, print method, lighting conditions, ink absorption, and file colour settings.
5.3 Exact colour matching is not guaranteed unless a specific colour matching service has been quoted and accepted in writing.
5.4 Minor variations in trimming, folding, scoring, binding, cutting, drilling, laminating, and finishing are normal in print production and will not be treated as defects where they fall within reasonable industry tolerances.
5.5 For folded products, brochures, booklets, menus, stickers, labels, signage, and custom items, small movement or variation may occur during finishing.
6.1 ABC Printing will make reasonable efforts to supply the quantity ordered.
6.2 For some print and finishing jobs, the customer accepts that a reasonable over-supply or under-supply may occur due to production processes.
6.3 Unless otherwise agreed in writing, a quantity variation of up to 5% may be considered acceptable. Where applicable, the final invoice may be adjusted accordingly.
7.1 Urgent or rush orders may attract additional charges.
7.2 The customer acknowledges that urgent production increases the risk of limitations, including reduced checking time, limited material availability, limited proofing time, and increased production pressure.
7.3 ABC Printing will use reasonable care, but will not be liable for delays or issues caused by urgent deadlines, late customer approvals, late artwork supply, courier delays, supplier delays, machine breakdown, or events outside our control.
8.1 ABC Printing may require full payment or a deposit before starting work.
8.2 Unless ABC Printing has approved a credit account in writing, all orders are payment upfront or payment on collection/delivery.
8.3 For new customers, custom jobs, large jobs, outsourced jobs, urgent jobs, or jobs requiring special materials, ABC Printing may require payment in full before production.
8.4 ABC Printing may pause, hold, or refuse production, delivery, collection, or release of files until payment has been received and cleared.
8.5 For approved credit accounts, invoices must be paid by the due date stated on the invoice.
8.6 If payment is overdue, ABC Printing may charge reasonable interest, administration fees, debt recovery costs, legal costs, and collection costs to the extent permitted by law.
8.7 The customer is responsible for any bank fees, merchant fees, chargeback fees, dishonour fees, debt recovery fees, or legal costs incurred by ABC Printing due to non-payment or disputed payment.
9.1 Ownership of printed goods, materials, finished products, and any work supplied by ABC Printing does not pass to the customer until all amounts owing to ABC Printing have been paid in full.
9.2 Until payment is received in full, ABC Printing may retain possession of goods and may refuse collection or delivery.
9.3 If goods have been released before full payment, the customer must return them to ABC Printing upon request if payment is not made by the due date.
10.1 Any request to change, pause, or cancel an order must be made in writing.
10.2 If the customer cancels an order, the customer must pay for all work completed, time spent, artwork prepared, materials ordered, supplier costs incurred, machine time allocated, administration costs, and any other costs incurred up to the date of cancellation.
10.3 Deposits are not automatically refundable. Deposits may be retained to cover work performed, materials purchased, production time reserved, supplier costs, and administration costs.
10.4 Once an order has entered production, the order cannot usually be cancelled, and the full quoted amount may be payable.
10.5 If the customer delays approval, artwork supply, payment, or instructions for more than 30 days, ABC Printing may treat the order as suspended and may invoice the customer for work completed and costs incurred.
10.6 If an order remains inactive for more than 90 days, ABC Printing may cancel the order and retain any deposit or payment to cover costs incurred, subject to Australian Consumer Law.
11.1 If the customer supplies paper, garments, envelopes, labels, media, packaging, signage material, or any other material, the customer is responsible for ensuring that the material is suitable for the intended production process.
11.2 ABC Printing may require extra material to allow for testing, setup, spoilage, misfeeds, finishing, wastage, and machine calibration.
11.3 ABC Printing is not responsible for defects, damage, wastage, delays, or poor results caused by unsuitable, faulty, incorrect, or insufficient customer-supplied materials.
11.4 ABC Printing may charge for counting, checking, testing, handling, storing, or preparing customer-supplied materials.
12.1 ABC Printing may use third-party suppliers, contractors, couriers, trade printers, designers, installers, finishers, signage suppliers, or specialist providers to complete an order.
12.2 ABC Printing will take reasonable care in selecting suppliers, but is not responsible for delays, shortages, errors, defects, freight damage, supplier price changes, or supply issues caused by third parties, except where required by law.
12.3 Any third-party supplier terms, lead times, material availability, freight conditions, and warranty limitations may apply to the order.
13.1 ABC Printing will notify the customer when the order is ready for collection or delivery.
13.2 Unless delivery has been quoted and agreed, the customer is responsible for collecting the goods from ABC Printing.
13.3 If delivery is requested, delivery charges will apply.
13.4 Delivery times are estimates only. ABC Printing is not liable for courier delays, postal delays, failed delivery attempts, incorrect addresses supplied by the customer, or delays outside our control.
13.5 Risk in the goods passes to the customer when the goods are collected, delivered, or made available for collection.
13.6 The customer must inspect goods immediately upon collection or delivery.
14.1 If goods are not collected within 14 days after notification, ABC Printing may charge reasonable storage or handling fees.
14.2 If goods remain uncollected for an extended period, ABC Printing may, after giving reasonable notice and subject to applicable law, dispose of, recycle, sell, or otherwise deal with the goods.
14.3 ABC Printing is not responsible for loss, damage, deterioration, or obsolescence of uncollected goods after the customer has been notified that they are ready.
15.1 The customer must inspect all goods on collection or delivery.
15.2 Any concern, shortage, damage, or defect should be reported to ABC Printing in writing as soon as possible, preferably within 7 days of collection or delivery.
15.3 ABC Printing may request photographs, samples, return of goods, or other evidence before assessing a claim.
15.4 If ABC Printing accepts that goods are defective due to our error, we may, depending on the issue and subject to Australian Consumer Law, repair, replace, reprint, refund, or provide another suitable remedy.
15.5 If the issue is minor and can be fixed within a reasonable time, ABC Printing may choose to repair, replace, or reprint the affected goods.
15.6 For a major failure under Australian Consumer Law, the customer may be entitled to choose a refund, replacement, or other remedy as provided by law.
15.7 ABC Printing is not required to provide a refund or reprint for change of mind, customer-supplied errors, approved proof errors, incorrect customer instructions, unsuitable supplied artwork, unsuitable supplied materials, or customer delay.
15.8 Any approved reprint or remedy will be limited to the defective portion of the order only, unless otherwise required by law.
15.9 The customer must not use, distribute, install, mail, resell, or alter goods that are claimed to be defective without first giving ABC Printing a reasonable opportunity to inspect them.
16.1 Nothing in these Terms & Conditions excludes, restricts, or modifies any right, guarantee, remedy, or protection that cannot be excluded under the Australian Consumer Law or other applicable law.
16.2 Where permitted by law, ABC Printing’s liability is limited to one or more of the following: replacement of the goods, repair of the goods, reprint of the goods, supply of equivalent goods or services, or payment of the cost of having the goods or services supplied again.
17.1 To the maximum extent permitted by law, ABC Printing is not liable for indirect loss, consequential loss, loss of profit, loss of business, loss of opportunity, loss of goodwill, loss of data, campaign failure, event loss, missed deadlines, or any claim exceeding the amount paid by the customer for the specific order.
17.2 ABC Printing is not responsible for customer business losses caused by spelling errors, wrong dates, wrong phone numbers, wrong QR codes, incorrect event details, incorrect pricing, incorrect addresses, incorrect logos, design choices, marketing performance, or content approved by the customer.
17.3 The customer is responsible for ensuring the final printed goods are suitable for their intended purpose before use, distribution, installation, mailing, sale, or promotion.
18.1 The customer warrants that they own or have permission to use all logos, images, designs, fonts, trademarks, names, copy, photos, artwork, and other material supplied to ABC Printing.
18.2 The customer authorises ABC Printing to reproduce, edit, print, and use customer-supplied material for the purpose of completing the order.
18.3 The customer indemnifies ABC Printing against any claim, loss, damage, cost, or expense arising from copyright infringement, trademark infringement, unauthorised use of images, breach of privacy, misleading content, illegal content, or any other issue with customer-supplied material.
18.4 Unless otherwise agreed in writing and paid for in full, ABC Printing retains ownership of working files, editable design files, concepts, templates, production files, print settings, imposition files, design systems, and internal production methods.
18.5 Upon full payment, the customer receives ownership of the final printed goods and a licence to use the final approved design for the purpose for which it was supplied.
18.6 Editable/source files may be supplied at ABC Printing’s discretion and may attract an additional fee.
19.1 ABC Printing may refuse, suspend, or cancel any order that we reasonably believe is illegal, offensive, defamatory, misleading, infringing, unsafe, discriminatory, abusive, sexually explicit, politically or socially harmful, or otherwise inappropriate.
19.2 ABC Printing may also refuse work where the customer is abusive, threatening, repeatedly changes instructions, fails to pay, supplies unsuitable artwork, or requests work that may expose ABC Printing to legal, reputational, or commercial risk.
20.1 The customer must keep their own backup copies of all artwork, files, documents, photos, logos, and data supplied to ABC Printing.
20.2 ABC Printing is not responsible for loss, corruption, accidental deletion, or damage to customer files or data.
20.3 ABC Printing may store customer files for convenience, but has no obligation to keep files after completion of an order.
20.4 ABC Printing may delete or archive files at any time after the order is completed, unless a separate file storage arrangement has been agreed in writing.
21.1 ABC Printing may collect customer contact details, artwork, order information, payment information, and delivery details for the purpose of quoting, producing, delivering, communicating, invoicing, and managing customer orders.
21.2 The customer is responsible for ensuring that any personal information supplied to ABC Printing has been collected and supplied lawfully.
21.3 Where the customer provides mailing lists, names, addresses, labels, or other personal information, the customer warrants that they have the right to use that information for the intended purpose.
22.1 Unless the customer advises ABC Printing in writing before production, the customer allows ABC Printing to photograph or display completed work for portfolio, website, social media, sample, or promotional purposes.
22.2 ABC Printing will not intentionally disclose confidential customer information where the customer has clearly marked the work as confidential in writing.
23.1 ABC Printing is not liable for delay or failure to perform caused by events outside our reasonable control, including supplier shortages, paper shortages, courier delays, machine breakdowns, power failure, internet failure, fire, flood, severe weather, industrial action, illness, government restrictions, transport delays, or other unexpected events.
23.2 If such an event occurs, ABC Printing may extend delivery times, source alternative materials, revise pricing, or cancel the order where performance becomes impractical.
24.1 Credit accounts are available only at ABC Printing’s discretion and must be approved in writing.
24.2 ABC Printing may withdraw or reduce credit terms at any time.
24.3 If the customer has overdue invoices, ABC Printing may suspend all current and future work until the account is paid in full.
24.4 Directors, business owners, or persons placing orders on behalf of a business may be required to personally guarantee payment where agreed in writing.
25.1 The customer must pay GST and any other applicable taxes, duties, fees, or charges in addition to the quoted price, unless the quote clearly states otherwise.
26.1 If ABC Printing does not enforce a right under these Terms & Conditions, that does not mean ABC Printing has waived that right.
26.2 Any waiver must be confirmed in writing by ABC Printing.
27.1 If any part of these Terms & Conditions is found to be invalid, illegal, or unenforceable, that part will be read down or removed to the extent necessary, and the remaining terms will continue to apply.
28.1 These Terms & Conditions are governed by the laws of New South Wales, Australia.
28.2 The customer agrees to submit to the courts and tribunals of New South Wales for any dispute relating to these Terms & Conditions, except where another jurisdiction applies by law.
29.1 These Terms & Conditions apply to all dealings between ABC Printing and the customer unless ABC Printing agrees otherwise in writing.
29.2 If there is any inconsistency between these Terms & Conditions and a written quote, invoice, or special condition issued by ABC Printing, the quote, invoice, or special condition will apply to the extent of the inconsistency.
29.3 By placing an order, approving a proof, making payment, or accepting goods or services, the customer confirms that they have read, understood and agreed to these Terms & Conditions.
